GENERAL TERMS AND CONDITIONS OF USE AND FOR THE SALE AND PURCHASE OF GOODS VIA THE E-COMMERCE WEBSITE “bluebag.coffee“

I. These General Terms and Conditions shall apply between:

„Blue Bag“ Ltd, with UIC 207270018, registered address: 7 Amsterdam Street, Sofia, and correspondence address: 7 Amsterdam Street, Iskar Oil Refinery 1528, Sofia, hereinafter referred to as the SUPPLIER for the sake of brevity,

and, on the other hand, the person who has agreed to these General Terms and Conditions, hereinafter referred to as the USER for the sake of brevity, in connection with the ordering and purchase of the goods on offer via the bluebag.coffee online shop.

These General Terms and Conditions govern the relationship between the Supplier and the Users (customers) who use the online shop www.bluebag.coffee to purchase goods. By clicking on an item, an image, a link (other than the one in the General Terms and Conditions) or a button on the website www.bluebag.coffee It is deemed that you accept or agree to the General Terms and Conditions set out below. These General Terms and Conditions comply with the requirements of the Consumer Protection Act (CPA), as well as with other legislation in force in the Republic of Bulgaria and the European Union. If you do not agree to these General Terms and Conditions, please do not continue to use www.bluebag.coffee

III. Registration. Leaflets
3.1. In order to be entitled to place valid orders for the purchase of the items offered in www.bluebag.coffee To purchase goods, the User must complete the online registration form or the checkout fields located at the following web address www.bluebag.coffee. When completing the online registration form, the user is obliged to provide the required and accurate information, and to update it within 7 days of any changes. The User warrants that the information provided during the registration/checkout process is true, complete and accurate, and that they will update it promptly should any changes occur. Should the User provide incorrect information or fail to report any changes within the timeframe specified in the preceding paragraph, the Provider shall be entitled to immediately suspend, without notice, the User’s account and access to it. The User may freely amend the information they have entered in the registration form.
3.2. By registering, the User gives their „online” consent to these General Terms and Conditions and is thereby deemed to be bound by their provisions. From the moment the User becomes bound by the terms of these General Terms and Conditions, they are able to place valid orders for the purchase of the goods offered via www.bluebag.coffee.
3.3. By registering and accepting these General Terms and Conditions, the User agrees to receive electronic correspondence, a newsletter, notifications regarding orders for goods and confirmations of changes to their details, as well as to receive advertising messages and information about promotions via email, SMS and by any electronic means.  The User may opt out of receiving brochures and/or notifications via their email and mobile phone at any time by:
3.3.1. use the dedicated web link provided in each leaflet and/or notice – the „Unsubscribe” button.
3.3.2. by contacting the Supplier at the email address or telephone number provided on the website, expressly requesting that no brochures and/or notifications be sent.
3.4. If, after opting out of receiving brochures and/or notifications, the User places an order, they shall be deemed to have consented once again to receiving brochures and/or notifications.
3.5. The Provider reserves the right to choose to whom to send brochures and/or notifications, and to remove from its database any User who has given their consent to receive brochures and/or notifications.
3.6. The supplier shall include in the leaflets and/or notices only advertising information relating to goods sold in the shop.

IV. Submission of orders
4.1. The user gains access to the form for placing orders for the purchase of the goods on offer after entering a valid email address and password in the relevant fields on the website and clicking the „LOG IN“ button.
4.2. Placing and completing an order is carried out by performing the following steps in sequence: selecting the type and quantity of the goods and confirming the type and quantity by clicking the “Complete Order” button displayed next to the relevant item, followed by specifying the quantity of the goods, confirming the delivery address and payment method, and confirming the order by clicking the “Place Order” button.
4.3. Once an order has been placed, the online shop www.bluebag.coffee notifies the User of the order via the email address provided during registration. A representative of the Supplier will contact the User to confirm the delivery time for the goods ordered.
4.4. In the event that the ordered goods (a specific product) are out of stock, a representative of the Supplier shall notify the Consumer. If the Consumer does not agree to the order being changed to another item (a similar model) or to the item being made to order, the order may be cancelled.
4.5. Orders in the online shop www.bluebag.coffee  are accepted 24 hours a day, 7 days a week.
4.6. Orders are processed from Monday to Friday between 10:00 and 18:00 Eastern European Time. Orders placed by 11:00, provided all items are in stock, may be processed on the same day. Once the order has been processed by the Supplier’s team, an order confirmation is sent. The order is then fulfilled and delivered to the Customer within 3 working days of the date of confirmation.
4.7. Orders received without correct User details, or where such details are missing, shall be cancelled if the Supplier does not receive the correct details within 48 hours of the order being placed. If an incomplete, incorrect or erroneous address and/or telephone number is provided when placing the order, the order shall be deemed invalid and the Supplier shall have no obligation to fulfil it.

4.8. For orders placed by telephone or email and delivered by a Blue Bag Ltd team, a fee of 5.00 BGN (excluding VAT) is charged for orders under 100 BGN (excluding VAT) within Sofia.

  1. Delivery and payment
    5.1. Once in www.bluebag.coffee When an order is placed by a Customer, the online shop’s automated system notifies the Customer via email that the order has been successfully accepted.
    5.2. Deliveries are made only for confirmed orders. Delivery takes place within 3 working days of the order confirmation date, unless the customer has been personally informed of a different timeframe by a company representative.
    5.3. Orders are not delivered on Sundays or public holidays. Delivery times are specified in the section: „Delivery and Payment“ on www.bluebag.coffee
    5.4. The Supplier uses the courier company ECONT for deliveries, with standard delivery times being from 9.00 to 17.00.
    5.5. The goods ordered shall be delivered in packaging and by a means of transport appropriate to their nature, to the delivery address specified by the Consumer.
    5.6. Delivery is made to the address specified by the Customer (whether a residential or business address) or to an ECONT office in the relevant city.
    5.7. If the Customer fails to provide access and the necessary conditions for the delivery of the goods to the specified address within the specified time limit, or fails to go to the specified Econt office to collect the goods on time, if they have chosen this option, the Supplier shall be released from the obligation to fulfil the requested delivery. The Customer may confirm their wish to receive the goods even after the expiry of the delivery period during which they were not found at the address, provided they bear all delivery costs. In this case, a new delivery period shall commence from the time of the confirmation referred to in the preceding sentence.
    5.8. Payment for the goods ordered may be made:
    5.8.1. „Cash on delivery” – payment in cash to the courier upon delivery;
    5.8.2. By bank transfer to our bank account as stated on the website at www.bluebag.coffee.
    5.9. For each item ordered, the User must pay the price stated in the online shop at the time of ordering. The price of each item may be subject to change at the Supplier’s discretion.
    5.10. All prices are in Bulgarian leva (BGN) and include VAT. The prices shown for individual items are for the specified quantity and do not include delivery costs. A customer wishing to pay the price in euros within the meaning of the Foreign Exchange Act need only change the currency by clicking the button displaying the price in Bulgarian leva.
    5.11. The consumer undertakes to pay the purchase price of the goods they have purchased, as well as any postage, courier or transport costs not included in that price, relating to the delivery of the goods.
  2. Cancellation of an order. Complaint.

6.1. A complaint may be lodged with the Supplier at the address specified on the website www.bluebag.coffee  the Supplier’s email address; at the same time, the Customer must return the goods within 14 days of the date of receipt.
6.2. In the event of a complaint, the Consumer may choose to have the specific item replaced with the same item free of defects, or in a different size or colour, or to return the goods in exchange for a refund of the amount paid. The Consumer shall pay the difference if the other item (with which the returned item is to be replaced) is more expensive; or the Consumer shall be refunded the difference between the replaced item and the new item if the price of the new item is lower than the price paid by the Consumer.
6.3. Goods may be returned, whether due to cancellation of the order or a complaint, in the manner and to the address specified on the delivery note/waybill with which the Consumer received the order.
6.4. In the event of an exchange of goods, the delivery costs are to be borne by the Consumer in both directions.
6.5. Product replacement: Please return the faulty items for replacement so that we can refund your money. If you wish to return an item, please contact us to obtain a Return Authorisation (RA) tracking number. You will need to provide us with the product’s serial number (if applicable), your address for delivery of the replacement item, and a contact telephone number.

VII. Copying information
7.1. All information published on the website www.bluebag.coffee  is the property of the Supplier, including photographs and descriptions of items.
7.2. It is prohibited to copy text from  www.bluebag.coffee  and their publication on other websites and online shops without the Supplier’s written consent.

VIII. Liability
8.1. The Supplier shall not be liable to any third party if such a party considers that information published on the online shop infringes any copyright or other intellectual property rights, insofar as the online shop’s website features photographs of products manufactured by the Supplier, and the photographic material has been commissioned by the Supplier.
8.2. The Supplier shall not be liable for any failure to provide access to the shop, or for the non-processing or delayed processing of purchase orders, in the event of circumstances beyond its control – cases of force majeure, unforeseen events, or problems with the global Internet network.
8.3. The Supplier does not guarantee that access to the shop will be uninterrupted, timely, secure or error-free, insofar as this is beyond its capabilities, control and will.
8.4. The Supplier shall not be liable for any damage caused to the software, hardware or telecommunications equipment, or for any loss of data arising from materials or resources searched for, downloaded or used in any way through it.
8.5. Insofar as the Supplier has neither the objective ability nor the obligation to monitor, and does not monitor, the websites and resources made accessible via the electronic links provided in the shop and in the user profile, the Supplier shall not be liable for the unlawful nature of the content and materials found on such websites and resources.
8.6. The Supplier shall not be liable for any damages or loss of profit arising from the use of, access to, or the inaccuracy of such materials and content.
8.7. The Supplier, its suppliers or third parties shall not be liable under any circumstances for any damages, loss of information, loss of profits or otherwise,  arising as a result of the use or non-use of the website, regardless of whether or not warnings have been given to the Provider. If the User’s use of materials from the website results in damage requiring repair, servicing or repair of equipment or information, the User shall bear full responsibility and all costs associated with rectifying the damage caused.
8.8. The Supplier has neither the obligation nor the practical ability to monitor the way in which the User uses the shop.

  1. Feedback
    9.1. Any User may contact the Provider to ask questions, make suggestions and obtain information. Contact may be made via the email address provided info@bluebag.coffee and on the telephone number +359 878 580 171. .

9.2. The Provider is the administrator of the website and, accordingly, of the comments and discussion section. In carrying out this role, the Provider may remove any obscene or offensive language that contravenes public decency and good manners.

  1. General Provisions
    10.1 The user may request the deletion of their account at any time. In such cases, the account will only be deleted once all validly placed orders have been fulfilled and the applicable price and delivery charges have been paid.
    10.2 The User shall be obliged to indemnify the Provider and any third parties for all damages suffered and loss of profit, including any costs and legal fees paid, compensation paid, and court costs, arising as a result of claims brought by third parties in connection with the User’s failure to fulfil their obligations, a breach of Bulgarian legislation, applicable foreign laws, these General Terms and Conditions, public policy and/or internet etiquette. The User shall also be liable to indemnify the Provider for any damages caused by third parties to whom they have disclosed their password, arising from the use of that password.
    10.3 The Parties declare that, should any part of these General Terms and Conditions be found to be invalid, this shall not render these General Terms and Conditions invalid as a whole, and the individual invalid clauses shall be deemed to be replaced by operation of law by mandatory provisions of the law.
    10.5. All disputes between the parties shall be resolved in a spirit of understanding and goodwill. In the event that no agreement is reached, all unresolved disputes arising from the relationship between the parties shall be settled by the competent court in Sofia.
    10.6. The written form requirement is deemed to have been met by sending an email, clicking an electronic button on a page containing content to be completed by the User, or ticking a box on the Provider’s website, and other similar means, provided that the statement is technically recorded in a manner that allows it to be reproduced.
    10.7. These General Terms and Conditions may be amended unilaterally by the Supplier. Amendments to the General Terms and Conditions shall not affect the relationship between the User and the Supplier arising from a purchase order for goods that was validly submitted prior to the notification. The current version of the General Terms and Conditions can always be found at www.bluebag.coffee/bg/privacy-policy and in the section checkout upon payment of the order.
